Kanye West Claims His Prenup With Kim Kardashian Isn’t Valid
Kanye West and Kim Kardashian’s divorce case might be finalized tomorrow, March 2, when Kim will ask a judge to formally restore her single status. However, Kanye’s lawyers have raised a weird issue about their prenup.
Per gossip website TMZ, Ye’s lawyers filed legal documents claiming prenups in California after 2002 are presumed invalid. The weird thing about that is the fact that West himself has never suggested their prenup is anything other than valid.
The law says a prenup is presumed invalid if, and only if, one of the parties who signed it challenges its validity, which Kanye hasn’t done. If he had challenged the prenup, he’d have to show it was either not entered voluntarily or it was “unconscionable.” When the prenup was signed, Kanye had a lawyer representing him, which makes it assumed voluntary. Kanye made a fortune during the marriage and all that money is his, so the invalid prenup claim is causing quite the confusion.
Regardless of the prenup confusion, Kim simply wants the divorce to become official and then work out custody and any property issues that remain. Sources told the gossip site that Kanye hasn’t been working with his lawyers — other than to make his position clear he doesn’t want a divorce.
